Participant Agreement, Assumption of Risk, Release of Liability, and Indemnification

In consideration for being permitted to participate in activities and utilize equipment, facilities, and services provided by Caney Fork River Rentals LLC and Caney Fork Outdoors LLC, including all affiliated entities, owners, officers, agents, employees, contractors, volunteers, and representatives (collectively referred to herein as “Caney Fork River Rentals”), I, on behalf of myself, my minor children (if applicable), my spouse, heirs, assigns, personal representatives, and estate, hereby agree as follows:

I Agreed To(Required)

I acknowledge and agree that I am voluntarily participating in all activities offered by Caney Fork River Rentals and, as a condition of such participation, I agree to release, waive, and discharge Caney Fork River Rentals from any and all claims, liabilities, damages, or causes of action, as set forth more fully below.

I acknowledge and understand that participation in outdoor and adventure-based activities—including, but not limited to, hiking, zip lining, canopy tours, biking, river rafting, canoeing, kayaking, and rock climbing— involves inherent, known, and unanticipated risks. These risks may result in physical or emotional injury, illness, permanent disability, paralysis, death, property damage, or injury to third parties. I further understand that such risks are an integral part of these activities and cannot be eliminated without fundamentally altering the nature of the experience. I acknowledge that guides, instructors, and staff of Caney Fork River Rentals LLC and Caney Fork Outdoors LLC are responsible for promoting safety; however, I understand and agree that they are not infallible and may make errors in judgment, fail to recognize hazards, or provide incomplete warnings or instructions.

I expressly acknowledge, accept, and assume all risks associated with my participation in the activities offered by Caney Fork River Rentals LLC and Caney Fork Outdoors LLC, whether such risks are known or unknown, inherent or not inherent, foreseen or unforeseen. I understand that my participation is entirely voluntary, and I knowingly and willingly choose to participate despite the presence of these risks.

I hereby voluntarily release, forever discharge, and agree to indemnify, defend, and hold harmless Caney Fork River Rentals LLC and Caney Fork Outdoors LLC, including their owners, officers, agents, employees, contractors, and representatives, from any and all claims, demands, damages, losses, or causes of action, whether known or unknown, suspected or unsuspected, that are in any way connected with my participation in these activities or my use of Caney Fork River Rentals’ and Caney Fork Outdoors’ equipment, vehicles, facilities, or premises, whether occurring before, during, or after such activities. This release and indemnification includes, without limitation, any claims arising from or alleged to arise from the negligence, acts, or omissions of Caney Fork River Rentals LLC and Caney Fork Outdoors LLC to the fullest extent permitted by law.

I certify that I have adequate insurance coverage to protect against any injury, loss, or damage I may sustain or cause while participating in these activities, or I agree to bear all costs and expenses associated with such injury, loss, or damage to myself or others. I further certify that I do not have any medical, physical, or mental condition that would impair my ability to safely participate in these activities. If I do have any such condition, I acknowledge that I have disclosed it and knowingly assume all risks associated therewith, and I agree to bear all costs, damages, or expenses that may arise, directly or indirectly, as a result of such condition.

I authorize Caney Fork River Rentals LLC and Caney Fork Outdoors LLC to obtain emergency medical treatment for me if I am unable to do so myself. I agree that I am responsible for all costs associated with such treatment, transportation, or related services.

If the participant is under eighteen (18) years of age, the undersigned parent or legal guardian hereby acknowledges and agrees that they are signing this Agreement on behalf of the minor and themselves. I, as the parent or legal guardian of the minor participant, hereby consent to the minor’s participation in all activities provided by Caney Fork River Rentals LLC and Caney Fork Outdoors LLC. I acknowledge and agree to all terms and conditions of this Agreement on behalf of the minor, including but not limited to the assumption of risks, release of liability, and indemnification provisions. I further agree to indemnify, defend, and hold harmless Caney Fork River Rentals LLC and Caney Fork Outdoors LLC from any and all claims, demands, damages, or causes of action brought by or on behalf of the minor, including those arising from the minor’s participation in such activities. I certify that I am the parent or legal guardian of the minor and have the legal authority to enter into this Agreement on their behalf.

I Agreed To(Required)

I acknowledge that Caney Fork River Rentals LLC and Caney Fork Outdoors LLC have provided me with a United States Coast Guard–approved personal flotation device (“PFD” or life jacket), and have instructed me on its proper use, fit, and wear. I understand that it is my responsibility to ensure the PFD is properly secured at all times during participation in water-based activities, and I agree that I will wear it as directed.

I acknowledge that the use of alcohol, illegal drugs, or any impairing substances before or during participation in activities is strictly prohibited. I agree that I will not participate while under the influence of alcohol, drugs, or any substance that may impair my judgment, coordination, or ability to safely participate. I understand that Caney Fork River Rentals LLC and Caney Fork Outdoors LLC reserve the right to refuse or discontinue participation at their discretion if impairment is suspected.

I Agreed To(Required)

I hereby consent to and authorize Caney Fork River Rentals LLC and Caney Fork Outdoors LLC to capture, use, reproduce, and publish photographs, video recordings, and/or audio recordings of me taken during my participation in activities, for any lawful purpose, including but not limited to promotional, advertising, marketing, training, and commercial purposes, in any media format now known or later developed, without compensation. I understand and agree that such use of my likeness shall not imply or constitute a direct endorsement by me of any product or service, unless separately agreed to in writing.

In the event I breach any provision of this Agreement, I agree to indemnify, defend, and hold harmless Caney Fork River Rentals LLC and Caney Fork Outdoors LLC from and against any and all resulting attorney’s fees, costs, or expenses incurred in enforcing this Agreement.

I Agreed To(Required)

In the event I initiate any legal action arising out of or relating to this Agreement or my participation in the activities provided by Caney Fork River Rentals LLC or Caney Fork Outdoors LLC, I agree that the exclusive venue for any such action shall be the state courts located in Dekalb County, Tennessee, or the federal courts located within the Middle District of Tennessee, as applicable. I further agree that this Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

I acknowledge that I have read this Agreement in its entirety, understand its contents, and voluntarily agree to its terms. I understand that I am giving up substantial legal rights, including the right to sue.

I agree that this Agreement shall remain valid and enforceable for all activities and participation with Caney Fork River Rentals LLC and Caney Fork Outdoors LLC occurring within the same calendar year (January 1 through December 31) in which this Agreement is signed. I understand and agree that this Agreement applies to all rentals, activities, and use of equipment, facilities, or services during that calendar year, and that I will not be required to execute an additional waiver for each subsequent participation within that time period. I further acknowledge that it is my responsibility to notify Caney Fork River Rentals LLC and Caney Fork Outdoors LLC of any changes to my health, physical condition, or other relevant circumstances that may affect my participation during that calendar year.

I acknowledge that I have been informed of the required return and/or pickup time for equipment and/or transportation. I understand and agree that failure to return equipment or arrive for pickup at the designated time may result in a late fee of $100.00, which I agree to pay.
